Our Services include AI-powered cryptocurrency trading assistants. You acknowledge and agree that:

• Cryptocurrency trading involves significant risk, including the potential loss of all invested funds
• Past performance is not indicative of future results
• Our AI assistants provide suggestions and automated trading based on algorithms, but we do not guarantee any specific outcomes or profits
• You are solely responsible for your trading decisions, even when using our automated trading features
• You should only trade with funds you can afford to lose
• Cryptocurrency markets are highly volatile and can change rapidly
• Regulatory changes may impact cryptocurrency trading and the functionality of our Services

5. Fees and Payment

We charge fees for certain aspects of our Services. All fees are described on our pricing page or within the Services. We reserve the right to change our fees at any time with notice to you.

You agree to pay all applicable fees and taxes associated with your use of the Services. All payments are non-refundable unless otherwise specified or required by law.

This includes, but is not limited to, any trading losses, loss of profits, loss of data, or financial losses incurred through the use of our AI trading assistants or other Services.

9. Indemnification

You agree to defend, indemnify, and hold harmless Xodis, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

10. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.
